These terms and conditions may be modified by ROSÉ HOME at any time, the user being informed of the existence of any new version of these that contains changes that are substantial.  
  1. The user

Access, navigation and use of the Website, confers the condition of user, so they accept, from the beginning of navigation through the Website, all the Conditions established here, as well as their subsequent modifications, without prejudice to the application of the corresponding legal regulations of mandatory compliance according to the case. The User assumes responsibility for the correct use of the Website. This responsibility will extend to:  
  • Make use of this Website only to make inquiries and legally valid purchases or acquisitions.
  • Do not make any false or fraudulent purchases.
  • Provide truthful and lawful contact information, for example, email address, postal address and / or other data.
The User declares to be over 18 years of age and have legal capacity to enter into contracts through this website. The Website is mainly aimed at Users residing in Spain. ROSÉ HOME does not guarantee that the Website complies with legislation of other countries, either totally or partially.
  1. Applicability of the general conditions

These conditions apply to all quotes, offers, activities, agreements and delivery of products by or on behalf of ROSÉ HOME. Deviation from these conditions is only possible if the parties have explicitly agreed in writing.
  1. Object

These conditions will regulate the use of the Web (https://www.rosehome.es) that ROSÉ HOME makes available to its users and customers. The purchase in ROSË HOME can be made from Spain, including the entire Spanish territory. The products that ROSÉ HOME sells through its website are mainly:   Home decoration objects   These General Conditions have been prepared in accordance with the provisions of Law 34/2002, on services of the information society and electronic commerce, Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, all legal provisions of mandatory application. ROSÉ HOME may modify them without prior notice, so it recommends a periodic consultation of them, even more so when it is willing to make effective use of its online store located on the web (https://www.rosehome.es). However, ROSÉ HOME always undertakes to have them updated, to publish the latest version and allow their access and printing at any time.
  1. Conditions of access and purchase

Access to the ROSÉ HOME Portal is free and attributes to the person who performs it the condition of User, regardless of the subsequent use of the services offered.   The acquisition of the products in (https://www.rosehome.es) can only be made by users over eighteen years of age, who must follow the steps and instructions that will accompany the entire purchase process, consistent, in a purely communicative way:
  • Completion of the registration form or the identification form of previously registered users.
  • On-screen display of the order summary, delivery conditions and shipping costs – where appropriate;
  • Acceptance of purchase conditions, which implies the reading, understanding and irrevocable acceptance of each and every one of these General Conditions, as well as, where appropriate, of the existing Particular Conditions and
  • Immediate receipt of summary email in the account used in the registration or – failing that – in the shortest possible period and always before the following twenty-four hours.
The acquisition of products is not allowed in (https://www.rosehome.es) for subsequent distribution or resale, either in public establishments or made in the domestic environment. ROSÉ HOME will regulate and authorize the necessary permits if at any time it consents, so it would reliably notify said authorization to the authorized agent.
  1. Orders

  No valid order may be made without expressly accepting, through the boxes enabled for these purposes, the terms and conditions and the privacy policy of ROSÉ HOME. All orders will be considered purchase offers subject to these terms and conditions. ROSÉ HOME reserves the right to accept them if the requirements provided for in these are not met. Once an order is made, the system automatically generates a proof of receipt of it. However, this confirmation does not imply the automatic acceptance of the order, since ROSÉ HOME reserves the right to collect additional information, related to the identity and address to guarantee, both a correct shipment of the order, and to ensure the absence of fraud related to the transactions. Orders can be placed 365 days a year, at any time, except when the service is suspended due to maintenance or other commercial circumstances and/or force majeure. Any order is subject to product availability. In the event that it is not possible to deliver an order due to supply problems or because there is not enough stock, the user will have the option to wait until the product is available or cancel the order.
  1. Reservations

  ROSÉ HOME always recommends that users make reservations of the products that interest them so that the availability of said product can be guaranteed at the time of its launch. There are two ways to reserve a product: cash on delivery or total payment.  
Reservations paid by deposit:
  If the sale price of the product changes between the payment date of the reservation signal and the release date you will always have to pay the lower amount of the two. You will never pay more and you will always have our guarantee ensuring the reservation of your unit.  
Reservations paid in full:
  In the event that a reservation of a product is confirmed and the sale price of the product in ROSÉ HOME goes up, nothing additional will be charged. In the event that the selling price of the product in ROSÉ HOME drops, ROSÉ HOME always does its best to offer compensation options. Reservations confirmed with payment are 100% guaranteed. In the event that the user wants to cancel a reservation, he can do so without problem by simply sending a cancellation request to the email hola@rosehome.es and the amount paid by it will be paid except for what is paid as payment and deposit in the reservation method “Guarantízamelo”. Unpaid reservations will be stored in the ROSÉ HOME system for a maximum period of 3 days after the product launch. After this period, the reservation will be lost. In special cases, the date on which it is required to complete the rest of the payment of a reservation may vary from what was originally indicated. In these cases, users will be notified well in advance. Release dates are subject to change. In the event that there is a change with respect to the launch date, it will be reflected in the same product sheet in ROSÉ HOME. In some specific cases of major changes to release dates, our customer service team will contact you to communicate the delay in the release date.  
  1. Delivery

Delivery will be considered to have occurred at the time when the user or a third party indicated by him acquires material possession of the products. The delivery time for the order will vary according to the selected shipping method and will be indicated on the website once the order confirmation is obtained, in any case, it will not exceed 30 days from the date of order confirmation. In the event that the delivery date cannot be met, we will inform the user of this circumstance and he will be offered the option to proceed with the purchase by setting a new delivery date or the possibility of canceling the order obtaining a full refund of the price paid. If the recipient is absent at the time of delivery, a notice will be left so that he can pick up the shipment at the place and within the indicated deadlines. After the period without the collection, the shipment will be returned to ROSÉ HOME.  
  1. Price and payment

It is understood that the price of each product is the one that will appear on the website at the time of placing each order. The user must pay the marked price, including the applicable taxes, together with the shipping costs that will be added to the final price to be paid. Prices can be modified by ROSÉ HOME at any time and without prior notice without affecting orders already confirmed. However, even confirmed ROSÉ HOME will not be obliged to attend to orders when the price is incorrect, especially when the error is manifest and easily recognizable. The accepted means of payment are: ROSÉ HOME BANK CARD reserves the right to change the payment methods, being able to create new ones or delete any of the existing ones, without the user / customer of https://www.rosehome.es being able to make claims for this reason. However, if the change in the payment method affects an order already placed, from ROSÉ HOME we would contact the customer to inform him of said change, offering him the option to cancel the order if he considers it convenient.
  1. Right of withdrawal

  Users may request the return of the products within 14 calendar days from their receipt, without the need to justify their decision and without penalty of any kind, through email addressed to hola@rosehome.es, or by making any other type of unequivocal declaration that indicates their decision to withdraw from the contract.   In the event that you have received a wrong or damaged product, we ask you to indicate this reason as a reason for return during the online return request, to be made with the same modalities in the previous paragraphs. You will be asked to upload one or more images related to the verified defect and you will receive a confirmation email with the instructions to proceed with the shipment.     In order to make the return, users must include a copy of the return slip inside the package or a note indicating the order number, and email address. Likewise, users may indicate the reason for the return, which in no case is mandatory, but helps us to improve the shopping experience for all our customers.   This withdrawal document is made available to the Customer that he can use at his discretion: Withdrawal Document   ROSÉ HOME Withdrawal Document will collect the product(s) that users wish to return at the place and time indicated by email. The collection time will depend on the availability of the logistics operator. ROSÉ HOME will confirm to users the date on which the collection will be made via e-mail.   Once ROSÉ HOME receives the return in its warehouses, it will proceed to pay the corresponding amount to the user.   ROSÉ HOME will refund the amount of the price of the product plus the corresponding shipping costs, deducting the logistical costs of the return, which will be €8. In the event that users do not want a collection, they can be in charge of organizing the return of the package at freight paid, in this case ROSÉ HOME will refund the total paid for the product. The refund of the amount paid will be made through the means of payment that the user used in the purchase and within a period not exceeding 14 days.   The product returned by users must be in the same box or packaging in which it was delivered, or failing that, in some similar format that guarantees the return in perfect condition.   In the event that the return requested by the user did not comply with the previous conditions or the delivered product had been manifestly used (provided that such use is not limited to the normal test to make a final decision on the acquisition of the product) ROSÉ HOME will return the product to the user, who must assume the corresponding shipping costs.
